Hey everybody!

Ok so I saw the legal doc part that was posted above. I don't understand what Praecipe means but basically what happened is that my lawyer met with Moxon privately before the Judge. Neither I nor the complainant needed to appear before him today.

In their meeting it was determined that:

- a T.R.O. wasn't necessary because I already need to stay away based on the conditions of my release from jail in the criminal complaint

- there will now be a status hearing before Judge Macaluso on Friday August 27. She is the Judge who will hear the case in its entirety starting Friday September 10.


That's all I can say about it for now. Sorry it's not more exciting but I have a feeling those parts are coming! Thanks so much for everyone's support on this both morally and financially. I won't forget it!

The TRO against Brian was denied because the criminal case already has a "stay away" order in place. The trial is now set for sometime after May 2011.

Does this mean Sparrow still cannot protest until the trial?

Yes. A "stay away" order in in effect. Sparrow will not be able to go near any DC Scientology property until after May 2011.

If the criminal charges were to be dropped for whatever reason, Moxon would have to seek an emergency hearing to be held within 48 hours to impose the "stay away order" on the civil case.

This is one of the reasons Moxon can successfully pull off this bullshit - he knows that the wheels of justice grind slowly.. he will take full advantage of that.. filing motion after motion, requiring Sparrow's attorney to respond, forcing Sparrow to endure months of hardship in terms of time, effort and money.

Moxon wants to bankrupt, torture and malign Sparrow until he is "shuddered into silence." (Fair Game policy).

So I had the status hearing today before Judge Macaluso. This takes the place of the original October 22 status hearing.

Moxon was there along with Kim Belotte, Sylvia Stanard and Vicki Turissi. Also, a surprise appearance by this Scientologist from Philly:

Why they would bring him to a status hearing (or at all) is beyond me.


So anyway, what happened today:


The judge said it was a moot point to pursue a TRO because the criminal complaint already enforces the stay away order. Moxon once again pressed the issue that if the criminal charges were dropped (for whatever reasons beyond his control) then it would be necessary to have this TRO to keep me away.

The judge told him that he is NOT getting the TRO and that should the criminal charges "go away", for whatever reason, then he can request an emergency hearing and one will be granted within 48 hours. So he said ok.


Then Moxon asked the Judge for permission to submit an amended complaint which she granted. She also granted my lawyer permission to submit a revised answer.

Moxon has until September 26 (iirc) to submit his and we have until October 15 to submit our answer.


The judge then set the upcoming trial events/hearings to be scheduled on what's called "Track 2" which is a medium pace for proceedings. My lawyer is going to forward that schedule to me but I don't think anything happens in the civil case now until late September.

The criminal case is set to begin with a similar status hearing like today's on September 10.


So that's all I've got for now. I will say that I like the judge so far. She seems like she is a no-nonsense/all-business kind of person. And in my opinion that is exactly what is needed in this case.

Hey what's up everybody. Here's the update:

So the only thing that happened this morning was a re-scheduling of this status hearing for September 23rd. We received discovery documents from the District Attorney only yesterday and my criminal lawyer is out of the country until next week. My civil attorney stood in for him and agreed with the prosecutors to push it back two weeks.


On the 23rd I will either ask for a trial or accept their plea deal (which isn't much). It basically says we'll still charge you with attempted stalking but you won't have to goto jail while you await sentencing. (Pft.)

My attorney accidentally coughed up my work schedule while picking a date for the reschedule so I'm sure Moxon caught that and will try schedule shit "around" it. I've already alerted my workplace though as to what is going on and I'll just say that they are intrigued and supportive so far. Also they love me alot.


I've reviewed the discovery documents and I'm flabbergasted at the contents. I'm not sure if getting too specific about what's in these can hurt me or not so suffice it to say that it's more of the same type of stuff found in the civil complaint only much much more.

At first I was outraged when reading the info. Then after I calmed down I read it again and realized that there's alot of new material there that is really going to strengthen both cases. Therefore

Moxon was there today with Vicki Turrisi but they were the only ones.

I got to listen to our judge preside over several similar preliminary type cases before they got to me and she seems excellent. At one point this one attorney kept interrupting her and she took it in stride which impressed the hell out of me. But finally she interrupted him and said keep it up and you'll be in contempt of court. It was sweet.

So that's all for now. Game on in two weeks.

Oh yeah also I'm scheduled for a Moxon deposition for the civil trial on October 14. I'm pretty pumped for that.
