Xavier,

I've never seen one, so it is very interesting to me so I read a little now and will finish the rest later after work. That site looks like it has nothing to with scientology? And how did you recieve it?? And why would they send you one?

Take Care, MHW

Site has nothing to do with Scientology--- (I don't own the site, a guy by the name of Max Goldburg does) His contact info: http://www.ytmnd.com/info/contact.html It's a matter of work in parody and satire by various users that make sites out of there.

I would believe it is an E-Mail sent through the contact box.

Here's the full letter at large:

Quote:
Church of Scientology sends a cease and desist

Dear Legal:

Our office represents the L. Ron Hubbard Library, the owner of the
copyrights to a number of photographs of Mr. L. Ron Hubbard, the founder of the
Scientology religion.

We also represent the Church of Scientology International ("CSI"), the
owner of the copyright in the graphic image file depicting the Scientology logo
and of the copyrights of certain photographs, as well as the copyrights to the
website, "scientology.org." CSI is also the exclusive licensee of the trademarks
and service marks of the Scientology religion, which include the term
"SCIENTOLOGY," the "SCIENTOLOGY CROSS" also depicted in the Scientology
logo, as well as the signature "Ron," and the "SCIENTOLOGY SYMBOL ("S" and
double triangle)." "SCIENTOLOGY" is registered with the United States Patent
and Trademark Office under registration numbers 1,775,441; 1,540,928; 1,342,
353; 1,329,474; 1,318,717; 1,306,997; 898018. The SCIENTOLOGY CROSS is
registered with the United States Patent and Trademark Office under registration
numbers 1012452 and 1325117. The signature "Ron" is registered under
registration number 1686383 and the "SCIENTOLOGY SYMBOL" is registered
under numbers 678,100; 1,296,040; 1,727,436; 1,646,324; and 1,280,999.

CSI and its sub-licensees use these trademarks in connection with
providing religious and humanitarian services and counseling, seminars, books,
classes, and lectures, among others. These marks are also used extensively on the
Internet. For example, many of these products, including numerous books on the
Scientology religion and services are promoted through a number of web sites,
including "www.scientology.org," "www.scientologyreligion.org," and
"www.whatisscientology.org," among others.

We likewise represent Bridge Publications, Inc. ("BPI"), the owner of the
copyright to the cover of the Dianetics book, which is registered with the United
States Copyright Office under registration number VA 1-056-398.

I. Copyright Infringement.

Please be advised that one or more of YTMND.com's subscribers have
placed a number of the L. Ron Hubbard Library's photographs, as well as CSI's
logo and a section from its website, scientology.org, and BPI's Dianetics cover, on
your website without the authorization of our clients. These copyrighted works

The action of placing these copyrighted works on your website violates
United States copyright law. Accordingly, we request your help in removing these
from your website.

The reproduction of a photograph in its entirety constitutes copyright
infringement. See Rogers v. Koons, 751 F.Supp. 474, 478 (S.D.N.Y. 1990) aff'd,
960 F.2d 301 (2nd Cir.), cert. denied, 506 U.S. 934 (1992); see also, Playboy
Enterprises, Inc. v. Russ Hardenburgh, Inc., 982 F.Supp. 503, 513 (N.D.Ohio

publication right by moving subscriber-uploaded photographs to common
bulletin board service files); Playboy Enteprises, Inc. v. Webbworld, Inc., 991
F.Supp. 543 (N.D.Texas 1997) (where court found that the owner of an internet
site infringed a magazine publisher's copyrights by displaying copyrighted images
on its web site); Kelly v. Arriba Soft Corporation, 280 F.3d 934 (9th Cir. 2002)
(where court found that displaying plaintiff's copyrighted photographs on
defendant's web site infringed plaintiff's "exclusive right to display the
copyrighted work publicly" under the Copyright Act)

II. Trademark Infringement.

We have likewise been advised that one or more of your subscribers is
using the above-referenced federally registered trademarks on each of his or her
webpages on YTMND.com's website. These can be found under the following
URLs:

You are hereby on notice that the use of our client's marks in this fashion
has caused you and these webpages to be falsely associated with our client's
marks and creates a likelihood of confusion as to the source or sponsorship of
these webpages in violation of United States state and federal law, including the
Lanham Act, 15 U.S.C. 1125(a).

Likewise, our client's trademarks are famous, distinctive and unique. The
use of the mark in this manner dilutes and tarnishes the distinctiveness of the
mark in violation of the federal trademark antidilution statute, 15 U.S.C.
1125(c) and the New York and California antidilution statutes, New York General
Business Law 360-l and California Business & Professions Code 14335. See,
Kraft Foods Holding, Inc. v. Helm, 205 F.Supp.2d 942 (N.D. Ill 2002); Victoria's
Cyber Secret Limited Partnership v. V Secret Catalogue, Inc., 161 F.Supp.2d 1339
(S.D. Fla. 2001); Mattel, Inc. v. Internet dimensions, Inc., 55 U.S.P.Q.2d 1620
(S.D.N.Y. 2000).

Accordingly, we ask your help in removing these trademarks from your
website, as well.

I have a good faith belief, and in fact know for certain, that the posting of
these works and trademarks by your subscriber(s) on these web pages was not
authorized by my clients, any agent of my clients, or the law.

I declare under penalty of perjury that this information is accurate and that
I am authorized to act on behalf of the L. Ron Hubbard Library, CSI and BPI in
this matter.

I appreciate your prompt attention to this matter.

Sincerely,
Ava Paquette

There's a message on the home page of that site stating that they got the Cease and Desist letter. Then followed up by some nice reader comments.

I love reader comments

Here's a link to the comments section:

Xavier, what is that site about? Thanks for the link. Funny read. 8)

Xavier, thank you for the interesting post. I like the bit where it says
that posting these pictures ( whatever they are ) causes your site to be
" falsely associated with our client's marks and creates a likelyhood of
confusion . . . ), man, you definitely do not want to be associated with
$cientology in any shape and form, so put a nice big disclaimer to that
end on your site . . .

It would be much quicker for them to write: " We represent our GOD L.R.
Hubbard and everything under the sky is ours. "

if hubbard looked at it during his lifetime, chances are that scientology is going to claim owenership of it.

Well folks, Scientology must have not paid much attention to the audience of YTMND for I believe that it has fired a massive bullet straight into its own foot for attacking them.. :D

The reason I say this is due to the fact that YTMND is a massive parody site with many many people that go there, and they tend not to take too kindly to the whole "cease and desist" stuff. ;)

Already many new anti-scientology pages have gone up and the redicule is becomming exponential. (the posts on Scientology related pages and on the replies are rather delightful)

I say a page earlier that said "YTMND is parody, so suck it Scientology!" and many are making fun of the cease and desist.

I wonder if the Church regrets trying to do that to YTMND yet. lol.

On a side note, people are upvoting sites that are on the "hit-list" as they call it as a third finger to Scientology. whee.

Scientology seems to send out these C&D letters the same way their members create their websites: Cookie Cutter. I have seen this exact style of letter before.

It would seem that what they do, is have someone cull the net ("surf tech"?) just looking for anything that contains C of S/Dianetics imagery and get a KR going on it (once they have audited out their enturbulation, anyway), then Moxon the Toxin goes to work and gets dear Ava to pump one of these dirt snakes out and fire it off with the URL transgressions/"crimes" put where they are supposed to be.

The hope seems to be that the receiver of the letter will begin to quake in fear that they have received a letter from a BIG, BAD legal firm attatched to SCIENTOLOGY and that fact alone will result in a flurry of activity to remove anything that would offend them without stopping to think how stupid the C&D letter actually is.

The problem is, the tactic is no longer working that well...

The site "Something Awful" pretty much laughed in the face of C of S when they got their C&D from them, as the material is clearly parody and fair use. In fact, IIRC, there was one site that did indeed take on the whole C of S vs. Parody issue in the courts and the C of S got their buttocks handed to them. Someone else (a person, not the poster) showed the C of S lawyers that they knew a thing or two about the laws, quoted case sources and never heard back from them again. Meanwhile, their satire continues.

It would seem, in the end, to be a great big scare tactic.

WTF!!! LOL!! How can they go after this site? hahahahaha. Those links with Scientology are funny. It's just stupid little pictures with music.

This is all parody - trademark or cease and desist allegations wouldn't hold up in any court. It doesn't apply here.

Oh - by the way, Ava, you missed a couple........

Oooh, and Scientology, you forgot these ones too. They are just as funny :)

Way to go Ava et al ! Keep applying standard tech on the internet, nothing can sink $cientology faster.

Max (the owner of YTMND) responded to the Cult legal threat and pretty much told them to get stuffed :D (aka, they have no case)

just a minor update friends,

I've finally finished the about page which includes some good history and a media sightings and staff page. check it out.

I have also told the lawyer that sent the cease and desist that it is completely groundless and I wasn't going to delete anything. It should only be a matter of time before YTMND is sued out of existence.

- Yeah, it seems like he's not scared. Good for him :D
