Over the past few months, there has been an increasing number of cycles coming onto OSA lines whereby Scientologists ™ have either started, or become involved in, custody suits or divorces that are ending up involving the Church.


An example of this that recently occurred was a custody suit which started some years ago, culminating in the suit going to trial two weeks ago with Church officials being informed when the trial was well IP. It was then found out by chance that evidence on the Church had been added into the record. Two senior executives had to go personally to handle, resulting in the suit being properly settled with no ruling at all.


The point being made here is that the cycle had nothing to do with the Church but we got inadvertently pulled into it and were not informed enough before the fact. By the time it did come to the attention of Church officials, it was almost too late.


Always in these cases, a tremendous amount of executive time and money is wasted on handling the situations when they reach Hill 10 proportion, due to the fact that the report lines are out and the OSA/DSA terminals in orgs are not getting informed or ensuring that they stay informed of the facts.


On receipt of this ED, the OSA/DSA terminals are to brief the staff of orgs and CLO's to immediately inform OSA/DSA of any divorce or custody suits or related data that they are aware of, falling under this category, and to keep the line in at all times so that it can be closely monitored. Any suits reported are to be immediately followed up with FULL data gotten and reported to OSA INT.

"There is all manner of legal type letters, government letters, accounting notices, assessments and such and phone calls received by persons in the org and this Pol Ltr FORBIDS it being routed all over the org to anyone and everyone.

IT ALL GOES TO THE LEGAL OFFICER"
"RECEPTION MUST ROUTE ALL LEGAL TYPE BODIES ONLY TO THE LEGAL OFFICER AND TO NOBODY ELSE EVER."

Facts needed are: names of parties and attorneys; what the issues of the case are; if Scientology has come up at all and in what capacity; etc.

If it is found that a suit has been FILED and not been reported, an immediate Committee of Evidence will be convened and held on all staff who knew about it prior to filing and didn't report it.


Two of the charges will be:

1) "Placing Scientology of Scientologists at risk". (HCO PL 7 March 65R III Revised 24 October 75 Corrected and Reissued 1 October 85 HCO DIVISION 1 JUSTICE OFFENSES AND PENALTIES), and


2) "Withhold of Vital Information." HCO PL 23 December 65RA Revised and Reissued 10 September 83 ETHICS SUPPRESSIVE ACTS, SUPPRESSION OF SCIENTOLOGY AND SCIENTOLOGISTS.


We MUST ensure that the Church is fully protected and does not get innocently dragged into something which is purely a personal matter between the concerned parties and has nothing to do with the Church.
