This is irrelevant. The Ordinance is about buildings, not land. It requires protesters to be 300 feet away from the residence being picketed, not the land on which the home stands. Standing on private land without the owners permission is already covered by the laws of trespass.
The protesters at Gold are not picketing an individual's residence, as their placards and actions make clear. They are picketing a property of the Church of Scientology where its employees work. Further, the County Supervisors were strongly advised by their legal counsel NOT to amend the Ordinance, since it was already following a narrow path between the right to protest and the right to privacy.
Looking at the aerial view, I assume there is no indication as to property lines on the ground? No 'Private Property Keep Out' signs? The boundary wall is well back from the property line, there is nothing of value that a trespasser could damage or steal. A reasonable person would not expect in such circumstances to be physically manhandled by security guards without receiving any warning that he was trespassing.
