Scientology suing Maria Pia Gardini for 2 million euros

Previous media thread on the cult's original threat to sue Maria pia Gardini and the publishers, the Daughters of St.Paul.....

In a bizarre but unsurprising twist (and gigantic footbullet) the cult has chickened out of suing the publishers and the co-author and decided to go ahead with a lawsuit directly on Maria Pia Gardini. The Director of Mondoraro Magazine, Gianni Leone reports in full support of Maria....

Scientology suing Maria Pia Gardini for 2 million euros

by Gianni Leone
March 31, 2010

Scientology is suing Maria Pia Gardini for 2 million euros and has cowardly decided not to face off against the publisher, Edizioni Paoline, or to sue the journalist co-author of her books, Albert Laggia. The persecutory intentions of the well-known psycho-sect, which is at the center of controversy and trials around the world, are clear.

In the citation [dated March 30, 2010 and available in Italian in a PDF file], Maria Pia Gardini is accused of having "behaved and spoken on many occasions with totally unjustified acrimony and anger toward the Church of Scientology" and of carrying out a plan designed to damage the psycho-sect, to defame it and to discriminate against it.

The interesting thing is that Gardini is cited because "the harm caused by these behaviors and injuries was suffered by the Church as an institution representing the Scientology community in Italy as well as by individual believers, who inevitably will be affected by the negative impact of the defendant's claims."

This is lunacy!

It's like saying that no one can legitimately criticize a religion. It's an act of censorship, of extreme legal violence which seeks to isolate, shame, and humiliate Ms. Gardini. For this reason, I not only express my solidarity with Ms. Gardini, but I formally request that Scientology or "Scamology, pay to believe ..." undergo the same treatment applied to Ms. Gardini and be taken to court in Italian territory. I would be delighted to launch a lawsuit against what is one of the most dangerous psycho-sects that operates worldwide. I would be happy to bring before any judge, the testimony and evidence I have gathered about the acts perpetrated by Scientology, which I love to call fondly: Diarrheology.

Like Ms. Gardini, I too, want to be accused of "using terms that are aggressive and clearly offensive, inasmuch as they denigrate the personality and honor" of Scientology.
Let this be a battle against silence and arrogance.

I appeal to the Anonymous group, which for years has fought Scientology worldwide.

My email is gianni.leone@mondoraro.info. I respectfully ask that you send to my address the material collected over the years: links, testimonies and documents.

I pledge that your material and the material collected by myself will be delivered to Ms. Gardini to enable her to present it in the case that concerns her.

Remember that Scientology in the U.S. is in the midst of a storm because the leaders have exploited, beaten, and underpaid their staff. Its employees were forced to work 7 days a week, from early morning until late at night, for fifty dollars a week.

Moreover, some former followers of Scientology in Italy have told me that the Scientology psycho-sect often sends Italian capital abroad disguised as donations.

For this reason, I formally, from the pages of this magazine, request:
  • that the competent authorities verify the actual funds and property of Scientology on Italian territory

that the Ministry of Health perform a verification concerning the "Narconon" communities which charge money for a detoxification method with no scientific value

that consumer groups campaign against this psycho-sect which operates on Italian territory and practices mental conditioning

that antitrust authorities take action against the "deceptive advertising" and "press releases" that Scientology spreads over the Internet
In conclusion, I appeal to all honest parliamentarians who know the dangers of psycho-sects to launch an inquiry into the real activity of Scientology in Italy.

The problem of psycho-sects touches 1 million people in Italy. It is a very grave problem which must be tackled seriously and firmly.

Message from Michel on ESMB/WWP who is talking to Maria and the journalist who published the above article in Modoraro.
MICHEL, posting on WWP wrote:MICHEL - MARIA PIA GARDINI NEEDS HELP! - Ex Scientologist Message Board

Church of Scientology Italy is suing Maria Pia Gardini for 2 million euros.

Maria Pia is shocked but she told me that she is confident. Most of all, she needs our help. She is an alone old lady.

Fortunately, Gianni Leone, Director of the UK-based MondoRaro.org website (Italy and worldwide news), is really interested in publishing in his magazine any material, testimonies and documents that would help Maria Pia in her lawsuit versus COS Italy.

I just sent my full life story as Scientologist to Gianni and gave him my autorization to publish it and to use it in Maria Pia's lawsuit. I will also testify before a court as needed.

Gianni's email is gianni.leone@mondoraro.info

Please, if you have anything to sent to him, do so. That will help a lot.

Italy is the 2nd Scientologist community in the world and it's time to make some noise in this country.

Thanks a lot to all of you.

Michel.

PS: Both Gianni and Maria Pia speak English and Gianni's company has a tranlation unit English - Italian - English. So feel free to sent anything you have in English.

Here is an English translation of the writ concerning the Church of Scientology of Italy's defamation lawsuit against Maria Pia Gardini. I am not a legal specialist, so this translation should be considered informal. I added links for the quoted references (all in Italian) that I was able to find online.

The writ bears the date of March 15, 2010 and was stamped by the Court of Grosseto on March 30, 2010. The date given in the document for the start of proceedings in court is September 27, 2010.

A PDF document containing the scanned Italian writ can be found at:

COURT OF GROSSETO

CIVIL DIVISION

WRIT OF SUMMONS

For: The National Church of Scientology of Italy, 61 Via Cadorna, Vimodrone, Tax Identification Number 97053570152, whose legal representative pro tempore is Mr. Mario Sala and whose defense is represented by attorney Marcella Coccanari, member of the Rome Bar with a postal address in Grosseto at the Law Office of Luigi Bonacchi, as special attorney for the present writ.

- plaintiff

Against: Maria Pia Di Gasparro Gardini, born in Rovereto on October 14, 1936, residing in Grosseto at Via Bonghi n. 1 - 58100.

- defendant

* * *

WHEREAS

3. Mrs. Di Gasparro Gardini has demonstrated and expressed on many occasions absolutely unjustified acrimony and anger toward the Church of Scientology and the intention of acting to damage the Church of Scientology in order to defame it, to discriminate against it or, to use Mrs. Di Gasparro Gardini's more succinct terminology, "to kick Scientology's ass" [translator's note: "inchiappettare Scientology", literal translation: "to bugger Scientology"].

4. The goal of the Church of Scientology is to preach, practice, and disseminate the Scientology religion, as stated in article 3 of its Statute.

5. Therefore, in fulfillment of its goals, the Church of Scientology does not permit, nor does it carry out, promote, or organize behavior that is disregardful and disrespectful to citizens and to the parishioners who are close to the church.

6. The allegations, explicited and detailed below, that have been made by Mrs. Di Gasparro Gardini, who accuses the Church of Scientology of acts on the fringes of the law, are groundless and unproven, as well as offensive, denigrating and defamatory.

7. The harm caused by these behaviors and insults was suffered by the Church as an institution representing the Scientology community in Italy as well as by individual parishioners, who are inevitably affected by the negative impact of the defendant's claims.

8. In particular, Mrs. Di Gasparro Gardini, in the books of which she is co-author together with journalist Alberto Laggio for Edizioni Paoline, in newspaper interviews, on television, and also in newsgroup postings, has repeatedly lashed out at the Church of Scientology, using terms that are patently aggressive and offensive, because they denigrate the integrity and honor of the injured party.

9. This refers in particular to expressions such as "Stupidology" [translator's note: the Italian word is "Sciemology", from scemo "stupid"], used instead of Scientology (EXSCN newsgroup, August 21, 2009: "Stupidology" ["Sciemology"]; EXSCN newsgroup, September 16, 2009 "the children of Stupidology" ["i ragazzi di Sciemology"]), referring to both the Church itself and to its parishioners; or "they are like snakes, they crawl everywhere" (EXSCN newsgroup, July 6, 2009) insulting and denigrating the parishioners who contribute to social improvement campaigns promoted by the Church of Scientology (against drugs, against illiteracy, in defense of human rights, etc.): "donations made by the fools" ["donazioni fatte dai gonzi"] (EXSCN newsgroup, February 11, 2009).

10. Not limiting herself to this, Mrs. Di Gasparro Gardini has repeatedly, without producing any evidence of what she claims, accused the Church of Scientology of undertaking acts of intimidation at the fringes of the law, attributing to Scientology parishioners extremely serious misconduct which is absolutely not tolerated within the Scientology community itself.

11. Above all, it bears repeating, without any evidence!

12. In particular, a list of statements by Mrs. Di Gasparro Gardini is provided below, along with the name of the publication medium.

4- "They're like vultures":

- "I miei anni in Scientology- Colloquio con Alberto Laggia" ["My Years in Scientology - As told to Alberto Laggia"], page 113, referring to officials of the Church of Scientology.

13. Therefore, in response to the above statements and claims of Mrs. Di Gasparro Gardini, the National Church of Scientology of Italy today considers itself obligated to proceed to protect its reputation and its honor, dignity, and integrity, as the institution representing Scientology in Italy and representing Italian parishioners and ministers, upon whom, as mentioned earlier, the defamatory and discriminatory effect of Mrs. Di Gasparro Gardini's conduct falls heavily.

14. It should be noted at this point that defamation is manifested and constituted whenever the reputation of a person is injured by expressions, news, OPINIONS, COMMENTS, which go beyond the limits of the free expression of thought. The protected legal interest is therefore defined "by a man's reputation, by the esteem which radiates throughout the social environment, by the opinion that others have about his honor and dignity" (Court of Cassation 28.2.1995) and is obviously damaged by statements such as those which have been quoted.

In a similar case, in which the offended party was the congregation of Jehovah's Witnesses, the court accepted the observations of the prosecution, who pointed out that the defendant had used terminology laden with aggressiveness and even more "direct and explicit, crude and coarse" expressions (such as those adduced above and used by Mrs. Di Gasparro Gardini, for example "Stupidology" ["Sciemology"], "vultures", "fools" ["gonzi"], "to kick Scientology's ass" ["inchiappettare Scientology]") and the court upheld the complaints of the injured parties because of the "expressions and phrases which are surely apt to offend the reputation of the followers of the religious denomination of Jehovah's Witnesses and which evidence a willingness to single out the followers for public scorn; there exists no cause for exemption from penalty, as the expressions used do not constitute the legitimate exercise of freedom of the press and of criticism. "

*_*_*_*

From the foregoing, it is quite evident that the National Church of Scientology of Italy has suffered and continues to suffer very heavy damages directly caused by the defamation perpetrated via the activity and statements of Mrs. Maria Pia Di Gasparro Gardini.

The verbal violence, the unjustified insults, the demonstrated acrimony and the false allegations by Mrs. Di Gasparro Gardini today lead the National Church of Scientology of Italy to protect the honor, dignity, and integrity of the Church and of the parishioners of the Scientology religion in this Church.

Regarding this point, it is necessary to emphasize that, given the manner in which the affront against Scientology was and still is being committed, the damage is far from being limited in time and is, on the contrary, extremely present, and therefore requires pre-trial intervention to protect the rights of the Church of Scientology and its parishioners even during the waiting period before this procedure.

For all the foregoing reasons and considerations, the National Church of Scientology of Italy, identified, represented, and located as stated at the beginning

Summons

Mrs. Maria Pia Di Gasparro Gardini, born in Rovereto on October 14, 1936, residing in Grosseto at Via Bonghi n. 1, to appear before the Grosseto Civil Court at its known address, chamber and judge yet to be determined, at the September 27, 2010 hearing, at the usual opening time, with an invitation to file an appearance at least twenty days before the hearing and to appear at the specified hearing, subject to the warning that filing an appearance after this period will mean the disqualification of Articles 38 and 167 of the Code of Civil Procedure, and that if she does not appear, the hearing will proceed in absentia, in order to consider the following

Conclusions

as a preliminary and precautionary measure: ascertain and declare the continuation and the perpetration of harm to the integrity, honor, and dignity of the Church of Scientology and its parishioners as a direct result of offensive and disparaging statements made by Mrs. Di Gasparro Gardini and of the continued public availability of these statements (in the form of books or postings in newsgroups or interviews), and consequently establish a precautionary withdrawal from distribution of the published works containing the offensive phrases, as well as prescribe a prohibition on further publication and distribution, in any form and by any means, of the contents and references of these publications;

on the substance of the complaint: ascertain and declare the grave and persistent damage inflicted by the defendant upon the integrity, honor, and dignity of the Church of Scientology and its parishioners;

consequently: determine that Mrs. Di Gasparro Gardini is required to pay compensation for damage suffered by the Church of Scientology in Italy as the institution representing the Scientology religion on Italian territory and suffered by all profoundly injured parties, whose integrity has been damaged and who are offended by the words and statements made by Mrs. Di Gasparro Gardini, as described above;

order the defendant to pay an indemnity for the damage suffered by the Church of Scientology of Italy to its integrity and honor as a result of the derogatory and defamatory actions perpetrated by Mrs. Di Gasparro Gardini and compensate this damage, quantifiable as a lump sum of 1,000,000 (one million) euros plus interest, or an amount determined to be equitable;

order the defendant, in addition, to pay an indemnity for the moral damage suffered by the Church of Scientology of Italy, in terms of moral hardship and suffering inflicted upon the parishioners and ministers of the Italian Church of Scientology and compensate this damage, quantifiable as a lump sum of 1,000,000 (one million) euros, or an amount determined to be equitable.

Useful reading to get a partial understanding of libel and insult laws. Scroll to page 78 for Italy...

There's still lot of holes in that resource for the Italy section.

also...
Italy has a law against "outrage to a religion," which has recently* been used against the journalist Oriana Fallaci over her outspoken statements and writings on Islam. That case, which adds a charge of "incitation to inter-religious hatred," [STRIKE]is still pending[/STRIKE]. [*note: Fallaci died age 77 in Sept 2006. Case not concluded AFAIK]

Due to Hubbard's infallible pronouncement that lawsuits should be used to harass, Scilons have been epic fail in the courtroom.

The most dramatic incident was the suit to bar publication of the OTIII materials by claiming the Xenu story was a trade secret... which was an admission that the materials were the real thing, not some evil SP forgery to subject Scilontology to ridicule as a space alien cult (which Hubbard, of course, did all by himself).

I sense another footbullet in the works.

In common law legal systems, filing this sort of a lawsuit calls the plaintiff's character into question. If something similar applies in the Italian system, then Maria Pia Gardini, as the defendant, could raise issues such as the legitimacy of Scilontology as a religion and the general public perception of Scilontology. Since they are claiming the reputation of the religion has been damaged, the defense could show that it's already so poorly perceived that it's impossible to damage.

In the classic case, a person can be libel-proof, which means their reputation is already so bad that it couldn't be worse. British have been known to find they were victims of libel, but only award "the lowest coin in the realm."

Truth should also be an absolute defense.

Gianni the journalist at Mondoraro reporting on this story has published on his site the entire WWP wiki page containing all the names of ex-scientolgosists who have publically spoken out.

Maria Pia Gardini apparently is not alone ... 963 people face-to-face fighting against Scientology
Written by Gianni Leone, Director Magazine

Mystery, Scientology, pay for believe Apr 6, 2010 Below is a list (public) of people who have left Scientology and expressed publicly against the psycho-sect.

For intellectual honesty to be told that some people still believe in the validity of the basic precepts of Scientology, but all have denounced the legitimacy and some methods used by vertices of Scientology. 963 people who fought or face-to-face fighting against the psycho-sect.

The list is taken from the site http://wiki.whyweprotest.net/List_of_ex ... spoken_out

The purpose of this list is to

■give courage to those who are still inside Scientology to leave permanently "Church",
■give courage to those who came from Scientology to tell their experience talk.
The list shows that there is a significant problem with the organisation of Scientology.

That is why I urge all to email me at: gianni.leone@mondoraro.info your experiences published, will certainly help many other people. Also, as you can see from the evidence that I posted, I guarantee anonymity to all those who require it.

[...wiki list of names follows in article...]
He also published OT7 ex-scientologist Kevin Mackey's story (in english this time).
http://www.mondoraro.org/2010/04/06/sci ... ey-part-1/

Although sometimes not directly related to Maria Pia Gardini's case, Gianni of Mondorora.org is basically going balls out with critical items in response to the lawsuit on Gardini and according to Michel on ESMB/WWP he reckons the Italian news media will be using these articles.

Update Dec. 1, 2010

Post by mnql1 » Wed Dec 01, 2010 10:03 pm

Update from Maria Pia Gardini, dated Dec. 1, 2010, translated from the Italian EXSCN discussion group:

https://groups.google.com/group/exscn/b ... 054?hl=it#
As you may have read, proceedings have have begun in Grosseto in the lawsuit brought against me by Scientology for my first book I miei anni in Scientology ("My Years in Scientology"), for which they are seeking 2 million euros. Their lawyer is from Rome and she is OT 4, or at least that is what I read in the Flag Service Completions.

Regardless of the fact that they are suing me for the first book after the second had already been published; regardless of the fact that they are suing me alone and not the publisher, Paoline, and not the coauthor, Laggia, contrary to what the law on publishing stipulates; regardless of the fact that 3 years have elapsed since the first book came out: I would like to quote article 7 of the Scientology Creed which states: "That all men have inalienable rights to think freely, to talk freely, to write freely their own opinions and to counter or utter or write upon the opinions of others."

As usual, they are very virtuous in writing, or at least Ron was, but when it comes to praticing what they write ... that is an entirely different matter altogether.

We shall see how it will end. Kisses to all.
